Terms of Sales

This document "General Sales Conditions" sets the conditions applicable to sales between visitors / persons who make purchases on the website VR360, and the company ONEVO, which has the trade name VR360.

Article 1 - Approval of the general terms and conditions of sale

At the time of the order, the customer acknowledges having read this document and declares to accept these conditions without.

This approval of these conditions is done by "click" via a checkbox clearly identified by the text "I agree with the Selling conditions without any restrictions".

Once checked, this box represents the electronic signature of the customer and results in the validation of the order by the customer. This form of signature known as "electronic" at the time of the order has the same contractual impact as a classic signature.

No order can be validated without the approval of these "general terms and conditions". By definition, any order placed on the site VR360 assumes the consultation and approval of the "general terms and conditions".

Article 2 - Application of the general conditions of sale

These conditions apply to all orders placed on the VR360 website. The site in question is published and operated by the company ONEVO, Limited Liability Company with a single shareholder capital of 10,000 euros. The head office of the company is located at 25 rue de la Petite Duranne 13 290 Aix-en-Provence, registered with the Register of Commerce and companies of Aix-en-Provence.

Article 3 - Online purchasing terms

The characteristics of the products are indicated on each product sheet and respect the article L 111-1 of the Code of the consumption, which plans that the customer can access the essential characteristics of the product before the final order taking place.

Descriptions and photographs concerning the products are not contractual, this information is intended to present the product and guide the customer in his choice. In case of an error on these elements, ONEVO’s responsibility can not be committed.

Product availability is posted on the VR360 website. In case of unavailability of a product, ONEVO will contact the customer who made the order as soon as possible to indicate the progress of his order. The customer will then be informed of the delay it will take to resupply the product by making the order available. In the event that the customer can not wait this deadline or the product is permanently unavailable and the order has been paid by the latter, the company ONEVO undertakes to reimburse the customer within 30 days from the date of payment of the order.

Offers and commercial operations are valid only within the available stocks and sometimes for limited periods, which are notified directly on the site.

Article 4 - Prices

The prices of the products indicated on the site are expressed in euros with all taxes included. A change in the VAT rate may affect the rates. Product prices do not include delivery charges.

The amount of the shipping costs is calculated and automatically generated following each order. The amount of the postage is valued on the summary of the order, before the payment procedure.

The company ONEVO reserves the right to modify prices on the site at any time. ONEVO undertakes to keep the rate indicated at the time of the registration of the order (order form) provided that the product is available on the same date.

The customer becomes the owner of the order once the full payment has been made. ONEVO thus remains the owner of the products until the total payment of the order. In no case the payment of sums which do not correspond to the total amount of the order can not be regarded as an arrh or a deposit.

Article 5 - Payment terms

The site VR360 offers different ways of payment to the customer to pay for his order.

Orders by credit card (CB, MasterCard, Visa) must be paid cash on the day of the order. A secure server is on the site to guarantee the security and confidentiality of the information provided during the bank transaction. The site also allows the customer to pay by bank transfer.

In this case, the transfer must be received and verified by VR360 within 5 working days after confirmation of the order. After this period, the VR360 website reserves the right to cancel the order.

The orders will be considered valid and accepted by VR360 when the banking partners of the site have given their agreement. Even after acceptance by the banking partners, the site VR360 reserves the right to accept the order on its own criteria, in order to limit the risk of fraud. $

Also, the site VR360 reserves the right to ask the customer to justify the identity and address of the cardholder. Once the documents have been received and checked, the VR360 site can make the choice to validate the order.

The VR 360 site may also agree to cancel the order and refund the customer if the documents are never received or they are found to be non-compliant.

Article 6 - Terms of delivery and transport

The products are shipped to the delivery address filled in by the customer on the order form. The sending of the order will take effect upon receipt and validation of payment (bank and VR360). Following the shipment, the order will be delivered to the customer within 2 to 5 days in Metropolitan France (subject to availability of items).

Different carriers will be able to provide the service to make the order available to the customer, either according to the customer's choice, or on eligibility criteria according to the delivery address specified by the customer.

It is the customer's responsibility to check the conformity of the delivered goods before signing any delivery document. The customer is the sole judge of the state of his order at the time of the recuperation of the goods.

Verification of the parcel is considered effective from the moment when the customer, or any person authorized on his behalf, has signed the document and accepted the goods.

In the case where the customer perceives a possible anomaly, he must notify its reserves, followed by signature, directly on the delivery document. In the case where the customer identifies a real anomaly (damaged packaging, open package, damaged or missing product (s)), it must reject the package and notify the transport document the reason for the refusal of the package.

In the case of a possible anomaly after opening, a real anomaly identified in the delivery that implies a rejection package, the customer must reaffirm and detail this anomaly to the carrier by registered mail with acknowleged reception within 2 working days. In the case where the order has been made available to the customer by the selected carrier and that it has not been claimed by the customer within the specified time, it will be returned to VR360, the return charges will be then on client fee.

Without the customer's manifestation with VR360, this return causes the cancellation of the contract and the refund of the order to the customer, which amount will be deducted from the return costs.

If the customer manifests before the refund of the order and he wishes to be reshipped the order, the latter will have to pay the sum of the expenses of returns and those of a new sending

Article 7 - Force Majeure

Neither party will have failed in its contractual obligations, to the extent that their execution will be delayed, hindered or prevented by a fortuitous event or force majeure.

Will be regarded as fortuitous event or force majeure all facts or circumstances irresistible, external to the parts, unpredictable, inevitable, independent of the will of the parts and which can not be prevented by them, in spite of all the efforts reasonably possible.

The party affected by such circumstances will notify the other party within ten business days of the date on which it became aware. The two parties will then approach within one month, unless impossible due to force majeure, to examine the impact of the event and agree on the conditions under which the execution of the contract will be continued.

If the case of force majeure has a duration greater than three months, these terms and conditions may be terminated by the injured party.

Expressly, are regarded as case of force majeure or fortuitous cases, besides those usually retained by the jurisprudence of the French courts and tribunals: the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning; the shutdown of telecommunication networks or difficulties specific to external telecommunication networks to customers.

Article 8 - Product Warranties

To help the customer in their purchase process prior to the sale, a summary of the warranty conditions are provided on each product sheet and are specific to each supplier and product.

In compliance with article 4 - decree n ° 78-464 of March 24, 1978, our general conditions of sale can not deprive the customer of the legal guarantee which imposes on the professional salesman to protect the customer against the possible hidden risks of the thing sold.

In case of difficulties to find information on the supplier, the site VR360 can help the customer in this search.

In the event that, despite the customer's requests to the supplier, they remain unanswered, the VR360 website can help the customer in his approach and try to find solutions with the supplier without obligation of results. In case of support by the supplier, the VR360 site can play the role of intermediary between the supplier and the customer.

Article 9 - Right of withdrawal

9.1. Right of withdrawal relating to the sale of equipment for individuals 

9.1.1. Time limit

The customer has a legal period of 14 days from the receipt of the order to assert his right of withdrawal and return the article or articles do not suit him (except software that have been opened).

If this period expires on a weekend (Saturday or Sunday),or holiday, then this period is extended until the next working day.

9.1.2. Condition

As the law indicates, the right of withdrawal only applies to unused items, unpacked and in perfect condition.

In all cases, the cost of returns will be borne by the customer.

9.1.3. Procedure

In order to identify the order concerned, the customer service will ask the customer for the reference of the order, accessible from the site VR360 under the heading "My account> History and details of my orders".

Without validation of the return by the customer service, the returned product (s) will be systematically refused by our services.

After receipt by us, the return will be accepted only if the product is in perfect condition for resale, in its original packaging and accompanied by all its accessories.

Without these conditions, the customer can not benefit from his right of withdrawal.

Any incomplete product, damaged or returned in a damaged original packaging, will not be refunded or exchanged.

The customer will bear the cost of return. Initial shipping costs, such as return shipping, will not be eligible for refund. The goods travel at the risk and peril of the customer. VR360 recommends to the customer to take all the necessary insurance to cover these risks and to take a particular care to the protection of the product or products (packing).

In the case where the right of withdrawal is exercised, VR360 will offer the customer: either a refund in the form of commercial credit (valid on the whole site vr360eshop.fr), or a refund on the customer's bank account within a time limit maximum of 15 days from the date on which the right of retraction has been exercised. The initial delivery costs (when ordering) are not refunded.

Return merchandise: In case you do not pick up your package, be aware that the return of this package is billed to our company. Failure to pick up a package is equivalent to order cancellation.

In case of cancellation of the order and for the orders whose delivery fees had been offered: we will deduct the sum of 11,90 euros.

In case of cancellation of order and for orders where the shipping costs had been paid: we will deduct the sum of 9.90 euros.

360 ° solutions and 360 ° cameras: from the moment the product was used, it is no longer considered a new product and is therefore no longer marketable by ONEVO. There is therefore no recovery possible use after.

9.2. Right of withdrawal concerning the sale of equipment and service for professionals

9.2.1. Right of withdrawal relating to the sale of equipment for professionals

Regarding the sale of equipment between professionals, the law sets the terms of this right of withdrawal and applies when:

- The contract is concluded outside the establishment

- The subject of the contract does not fall within the main field of activity of the purchasing company

- The purchasing company does not employ more than five employees

Only if these three conditions are met, the company benefits from a right of withdrawal of 14 days.

 9.2.3. Conditions and deadlines concerning our services for professionals

In the case of a cancellation of your order related to our virtual reality services:

- More than 14 days before the start date of the service: we keep 50% of the deposit on the total amount of it.

- Less than 14 days before the start date of the service: we keep 100% deposit on the total amount of it.
